                                              Zeste French Tours                   CONTRACT 

                Services provided by Zeste French Tours are outlined in the itinerary. Please read the conditions carefully.

                Booking Conditions:

                The booking conditions constitute a legally binding contract between Zeste French Tours Pty, Ltd. of 109 Kangaroo Ground Rd, Warrandyte, in the State of Victoria Australia (ABN: 57104840929) and you for the services provided by Zeste French Tours.  This contract shall be governed by the State of Victoria and the laws of that State shall apply to it.

                Prices

                Prices are based on exchange rates and costs applicable in 2011.

                Airfares, passport and visa fees, travel insurance, excess baggage charges, airport taxes, extra meals, tips, laundry, drinks, medical expenses, optional activities and any items of a personal nature are not included in your trip price.

                Accommodation standards

                Accommodation standards can vary dramatically throughout the region and hotel rooms are often smaller than equivalent properties in Australia. The hotels and gites are generally selected for their locations, “ambience” and price. Without sacrificing regional customs and standards, where possible, emphasis is placed on cleanliness.

                Prices are based on twin share. Travellers who require a single room or an upgrade of accommodation provided will incur a supplementary cost.

                Special requirements

                The tours necessitate a reasonable amount of walking, particularly around hilltop villages and some cities. While the walking is normally quite easy, if you are in any doubt please tell the guide beforehand so that other arrangements can be made.

                Zeste reserves the right at its absolute discretion to terminate the client’s tour contract, or decline to carry the client further, with no right to refund, if the client acts in a way that is illegal, unsafe or interferes with the well-being of, or causes inconvenience to other passengers.

                Payment terms

                Standard Deposit: A deposit of $AUD1000 is required to confirm your booking.

                Final payment is due 90 days prior to departure from Australia.

                Zeste cancellation fees:

                If you wish to cancel this contract you must pay the following cancellation fees as liquidated damages:

                90 days prior to departure- forfeit of deposit

                75 days prior to departure – forfeit of deposit plus 50% balance owing.

                60 days or less prior to departure – 100% total cost


                Exclusion of liability

                Except where stated otherwise, Zeste acts asyour agent when making arrangements for your tripwith service providers. Where Zeste provides services it will do so with due care and skill. Zeste is not responsible for the acts and omissions of others, including airlines and accommodation providers or for any loss, damage, death, injury and expense which you may incur as a consequence of the acts and omissions of others.

                Zeste will not accept any responsibility or liability if you contravene any law or regulation of any country or region visited. Any independent arrangements that you make that are not part of the Zeste trip [including pre and post accommodation] are entirely at your own risk.

                Changes to your holiday

                You acknowledge that travelling with Zeste requires a degree of flexibility, good humour and the understanding that the itinerary, accommodation, and/or modes of transport may change, even after the tour’s commencement, without prior notice due to local circumstances. Changes may occur due to “force majeure”, poor road conditions, weather, availability of tickets, vehicle breakdown, or other forces beyond Zeste’s control or which cannot be reasonablyforeseen.

                Travel Insurance

                Adequate and valid travel insurance is compulsory for all Zeste travellers. Your travel insurance must cover accidents, injury, illness and death, medical expenses, including and related to pre-existing medical conditions, emergency repatriation and personal liability. You must carry proof of insurance with you.

                Please ensure that your passport is valid for 6 months beyond the duration of your holiday.

                Company responsibility

                Zeste French Tours is not itself a carrier or hotelier, nor does it own hotels or buses. The services that the Company supplies on your behalf consist of arranging and coordinating accommodation, tours, workshops, other activities and making bookings etc. We exercise every care in the selection of reputable operators and suppliers. It is important to note that all bookings with Zeste are subject to the terms and conditions of liability imposed by such suppliers.

                Refunds 
                 No refund is available for cancellations after travel has commenced or in respect of any tours, accommodation, meals or other services not utilised.
